Krzysztof Bosak:
– We want to mention to a case that ignited political emotions yesterday and is simply a very serious matter, due to the fact that it truly makes questionable the functioning of the democratic strategy that we have in Poland.
Named yesterday. The State Election Commission has decided openly to break the law. At the same time, next year we have presidential elections, and it will be up to the State Election Commission and its way of acting that will depend on these elections, the way they run, the approval of the results. That this is neither trivial nor purely theoretical, we see after the case of Romania, where democratic election results are being questioned. We besides see another countries where there are sometimes immense disputes around it.
What happened? The State Election Commission, having absolutely no legal basis, simply stated that it would not work. Thus, its members, who, in our opinion, are committing an abuse of powers in the opinion of our legal team, namely an offence in Article 231. Penal Code.
This obstruction is intended to lead to the unlawful non-payment of subsidies to 1 of the opposition political parties. We are rather selfless here due to the fact that they are our competitors who just got tens of millions from the state budget. We believe that the strategy of financing political parties in Poland is poorly constructed, but since it is and is passed by an crucial law and all parties have so far been beneficiaries of it, this right must be respected!
The State Election Commission, acting illegally, criminally, interferes with elections. Depriving 1 of the political parties of backing in the election year is an apparent interference in the presidential electionon which the further constitutional form of the Republic depends. This is absolutely apparent to anyone with a head on their neck. Article 7 of the Constitution is broken, let us remind you, public authorities operate on the basis and within the limits of the law. Not what it seems to people who are in different bodies, but by law! If they do not have a basis for any action enshrined in the Act, specified action is unlawful.
That's why we think They're just committing a crime under Article 231 of the Criminal Code. And it's not a trivial crime, due to the fact that it's not a petty negligence. This is interference in elections, in the very heart of the democratic system, by the body set up to uphold stability, transparency of principles. It is hard to have a more blatant violation than to seek, by obstruction, the failure of the ultimate Court's final judgement on the eve of the presidential campaign, concerning the financing of the party, where it is known that these run funds are needed.
The second is, of course, breaking the Electoral Code, except for breaking the Constitution and violating the Criminal Code. We're talking about an article here. 145 paragraph 6 of the Electoral Codewho states very clearly that Following the ultimate Court ruling, the Electoral Commission has no legal choice and the Electoral Code straight obliges, quote, “it immediately decides to adopt the accounts”.
It shall immediately inform the Commission thereof. No dispute about any doubts matters here at all. Each of us can have any political opinion. Anyone can have an opinion. On the another hand, the political opinion of PKW members, members of the ultimate Court, journalists in Poland is not a law! There's something very, very incorrect here.
There is simply a group of people in Poland who believe that they are above the law. He considers that it does not substance what is written in the laws, in the judgments; that they themselves are simply the law. Well, ladies and gentlemen of PKW, dear any judges, dear politicians: you are not a law. You're not the law! Here is Poland, here are the laws, here is the Constitution. We don't like quite a few these laws. We don't like your actions. We don't like you two. However, if we are to coexist peacefully in this country, you are to comply with what is written in the laws.
And no uncertainty about you is above the law. no of your instrumental references to any rulings of global tribunals on circumstantial cases where these tribunals multiply doubts. You may have these doubts and these tribunals may have doubts. On the another hand, they do not exclude the activities of the most crucial bodies of our country. And of course you can have your opinion on this. We besides frequently enjoyed very different sentences, different laws did not like. On the another hand, we have never gone to specified radicalism as yourselves to claim that something in the state is not valid. What you do is simple anarchy. And the Confederate of this anarchy opposes.
And the Confederate expects: anyone who contributes to anarchy in our country to be punished and settled. And that next year fair elections will be held in Poland, alternatively than accelerating the power of full Donald Tusk in cooperation with abroad institutions, with support from outside and with discrimination against political opposition, whether from Confederacy, PiSu or from any another party.
Finally, it is worth noting that this situation is blamed by the organization who is presently injured. That's the party, Law and Justice, so changed the plan of the State Election Commission that it allowed – and the president elected from this organization signed specified a bill – that it enabled the majority of parliament to the body to control the election, nominate the majority of members. If it hadn't been for this change, this situation wouldn't have happened.Oh, my God! It is besides worth remembering.
We warned, being opposed, that the centralist approach of PiSu, politicising all institutions 1 by one, would consequence in the failure of power and these institutions being taken over by their opponents. That's precisely what happened. It is worth remembering who warned and who established the stupid law that is now taking revenge.
We request a constitutional reset. We can start this constitutional reset by depoliticising the PCW. We anticipate that there will be no people there who make specified decisions.
