The president of the ultimate Court, prof. Krzysztof Wiak, clearly explains that Polish electoral law does not supply for a mechanics for recalculation of votes across the country where no circumstantial irregularities have been reported. In the context of many electoral protests following the second circular of the 2025 presidential election, this message is crucial for the further conduct of the case and the stableness of the electoral process.
PKW has completed its work, now the ultimate Court decides
Last Monday, the State Election Commission approved the authoritative presidential election report. This paper is the basis for the final decision on the validity of the President's election by the ultimate Court, specifically by the home of Extraordinary Control and Public Affairs (IKNiSP). This home is presently considering incoming electoral protests which question the result of the vote and may affect the final outcome.
The law knows only local protests and card viewing
Prof. Wiak stressed that the Electoral Code allows for protests only in relation to circumstantial electoral commissions where there are suspicions of irregularities. In specified cases, the ultimate Court may carry out an examination of election cards or apply to the General Court for assistance in this action. It was on this basis that the decision was made to recalculate the votes in 13 elected committees.
No grounds for mass conversion
Despite the increasing demands from politicians and sympathizers of any groups to convert all the votes cast in the country, Prof. Wiak powerfully points out that there are no rules or legal bases that let specified actions. Even if the allegations raised concern respective 100 committees, verification of all 31,000 electoral committees is impossible and legally impossible.
The challenge of assurance in the state and electoral commissions
The president of the ultimate Court besides points out that groundless requests for recalculation of votes on a massive scale may undermine assurance in state institutions. They besides stigmatise the members of the electoral committees and the men of trust and observers present at the vote, which is dangerous to the stableness of democratic procedures.
