I have requested the Ombudsman to intervene in connection with the announcement by Minister Barbara Nowacka of a compulsory sexualisation programme in schools (under the misleading name “health education”), which violates Article 48 and Article 53(3) of the Constitution of the Republic of Poland!
CONTENTS OF THE PROPOSAL
“The Minister of National Education has taken a political decision to introduce a mandatory subject for children on sexuality and publically declares that she does not care about criticism and opposition, which publically demonstrates the fictional nature of public consultation of the government prepared.
According to Article 48(1) of the Constitution, parents have the right to rise children in accordance with their own beliefs. Furthermore, in accordance with Article 53(3) of the Constitution, parents have the right to supply children with education and moral and spiritual teaching in accordance with their beliefs.
Meanwhile, the incumbent Minister of National Education all voices resembling this content of the Basic Act comment on political attacks against conservative social groups. In addition, he conducts a façade public consultation of the proposed amendments to the regulations of the Minister of National Education, which he admits in the media through further claims of not accepting criticism and opposition.
It remains to be hoped that the function of the Ombudsman is not at present limited to façade activities to be kind to the authority interfering with constitutional rights and civilian liberties. I ask you to act as a parent and as a associate of the European Parliament with an important, individual democratic mandate.
The Constitution of the Republic of Poland, despite its many shortcomings, provides for an institution to defend the rights and freedoms of its citizens in the event of their threat by the executive authority. The current government, under the pretext of criticism of the erstwhile one, does not recognise many provisions of the Constitution limiting its action. This time it has its expression on the substance of the interfering thousands of parents and their children. It is hard to find more delicate substance of demolition of the Polish state. In addition, this is all happening in the form of the adoption of the Minister's Regulation – without the statutory legislative process.
According to your constitutional role, it is justified to take action before the minister in office, with contempt for the criticism of citizens, violates constitutional rights in specified essential matter."
