The decision of the Olsztyn territory Court raises immense controversy. 2 19-year-olds, suspected of planning terrorist attacks, were released from custody, despite the fact that the court found evidence "highly crop-like" to blame them. Why were they released? The justification of the court raises an avalanche of questions and concerns among residents.
The court released the suspects – what happened?
The Olsztyn territory Court did not extend detention for 2 young men accused of preparing a terrorist attack. Although the prosecution requested further detention, the judges considered that preventive measures of a free nature were sufficient.
A spokesperson for the Olsztyn territory Court, Adam Barczak, reported that:
‘for the appropriate follow-up of the investigation, it will be adequate to apply measures of a free nature, the nature and degree of which the prosecutor will decide.’
The court admitted that the evidence gathered powerfully points to the defendants' guilt, but concluded that there was no hazard of obstruction of justice.
Why is this decision opposed?
Problem is, the case is planning a terrorist attack - not just a crime. The people of Olsztyn fear that suspects may now implement their plans, not just affect evidence.
The court found that:
‘There is no reason to assume, at this phase of the procedure, that there is simply a legitimate concern that suspects will have any unlawful effect on the evidence already collected or otherwise impede the proceedings.’
Is that adequate safety erstwhile it comes to terrorism? Many experts and average citizens have doubts.
What about the investigation?
The D.A. may challenge the court's decision, but for now, the defendants are at large. The authorities have not disclosed precisely what preventive measures (e.g. police supervision, ban on leaving the country) have been imposed on them.
Does that mean the investigation is in danger? Or did the court consider that the evidence was strong adequate that there was no hazard of escape or continued criminal activity? These questions stay unanswered for now.
Summary
The decision of the Olsztyn court caused a storm. On the 1 hand, formally justified, on the another hand, with serious public concerns. Is that right? Time will tell if firing suspects would endanger public safety.
