The Ministry of improvement conducts secret recruitments for key ponds. Dear Sir, referring to the request for public information on the indication of who is on the list of candidates in the competition for the Main Geodeta of the Country and the Main Inspector of Construction Supervision and the availability of copies of papers related to, whether indirectly or directly, and indicating specified a situation, I kindly inform you of the following.
First of all, it should be stressed that who is the candidate for the position of the Main Geodeta of the Country and the Chief Inspector of Construction Supervision decides the circumstantial application in the competition, made by a natural person. specified a individual shall act on his own behalf in the field of his private interest. For this reason, private papers submitted in the recruitment process by candidates for the above-mentioned posts, i.e. application, graduation diploma, work certificate, etc., do not contain information on public matters and do not constitute public information.
This means that they are not subject to the Act of 6 September on Access to Public Information (Journal of Laws of 2022 item 902; hereinafter referred to as ‘U.d.i.p.’). As regards the request for information on the candidates themselves for the positions of the Main Country Geodeta and the Main Building Supervisor, it should be noted that information in this respect is not public either. Candidates in the competition for the position of the Main Geodeta of the Country or the Chief Inspector of Construction Supervision do not execute public functions.
Applicanting for these posts does not affect in any way the exercise of public, sovereign or public spending powers, which disqualifies this information as public information. In the present case, only the result of the recruitment is public information within the meaning of the u.d.i.p., as it refers to the indication of the individual to take up the public function as he meets certain formal and substantive requirements.
