The court did not take into account the complaint of the independency March Association relating to the search of its office in September 2024. At the same time, the deadline for issuing a message of reasons was besides deferred.

As the spokesperson for the Warsaw-Prague territory Attorney's Office informed Norbert Antoni Woliński, The court issued a decision relating to the search of the office of the independency March Association. The court rejected the complaint of the organisation to enter their premises, but at the same time did not state the reasons for its decision. However, it will be forwarded to the organization within 7 days, since for that time the Court of First Instance deferred the issue of the message of reasons. The order in this case is final.

The current president of the Association of independency March Bartosz Malewski points out that the Court of First Instance has mostly divided the position of prosecutor. "He acknowledged to us in this respect that the police who carried out the work did not give us the decision to search the premises before proceeding," he said.

He added, however, that the Court of First Instance considered the deficiency of notification to be insignificant in the context of the case.

Earlier the complaint for the search was brought by the Association of Industrial Names II, to which the searched premises belong, as well as another entities declaring the usage of these premises: the Association of the triumph March, the Association of Youth of All Poland and the National Social Institute Foundation.

‘The court did not take any of the complaints into account, not recognizing any of the charges raised by the applicants. The search was considered legitimate, legal and correct" - said Prok. Wolinski.

He pointed out that according to the court's assessment, uncovering the wanted evidence at the association's office was highly likely and that it was essential to effort to get it.

Prosecutor Norbert Antoni Woliński pointed out that the Court of First Instance confirmed the request to teardrop down the locks at the door, noting that the decision of the search until the keys were delivered, that is, by 2 days – as expected by the complainant – would hazard removing or hiding key evidence.

Let us remind you that on the morning of September 4, 2024 the police entered the office of the independency March Association in Warsaw, under the pretext of searching for material that might interest the prosecution in a case concerning unclear events from the independency March of 2018. On-site, however, the officers did not limit themselves to searching for interesting data which according to the declaration of the association authorities do not exist.

At that time, Krzysztof Bosak presented details of the case on the X platform. "The case of searches ordered by the Public Prosecutor's Office supervised by Adam Bodnar in the premises related to the March of independency is besides curiosity, scandalous and not accidental. To my knowledge, the point is that during a 100-year march of almost a million people on the 100th anniversary of independence, individual felt frightened and accused the organizers after the march. The prosecution is so looking six years later for a man who was liable for the threat, not knowing his identity, neither having his photographs nor even a description," stressed the Confederate politician.

“The organizers of the march six years ago testified that they did not know what or who. The case was dropped years later and now resumed for political reasons. The prosecutor so demands the release of non-existent lists of names of all active in organizing the march in 2018. No real victims. No perp. No evidence. No witnesses. But this is not a problem for prosecutor Maciej Młynarczyk," Bosak added.
