The D.A. demands charges against Robert Bąkiewicz. The Border defender and the Military Police were to be insulted

Regional lawyer in Szczecin issued an order to present charges to Robert Bąkiewicz in connection with the incidental at the border crossing point in Słubice, which took place on 29 June.

The case raised controversy already at the prosecutor's phase – investigators from Gorzów Wielkopolski considered that there were no grounds for charges, but their superior was of a different opinion.

The authoritative communication of the Regional Prosecutor's Office in Szczecin states:

‘Regional Prosecution in Szczecin, acting pursuant to Articles 7(3) and 22(4) of the Act of 28 January 2016. Law on the Prosecutor's Office (Journal of Laws of 2024, item 390 as amended), after individual examination of the materials of the case on the mention 3038-l.Ds.21.2025 of the territory Prosecutor's Office in Gorzów Wielkopolski, in view of a different assessment of the evidence made by the prosecutor – the case referee and Deputy territory Prosecutor in Gorzów Wielkopolski, issued an order as to the content of the procedural action.”

As clarified, it is simply a provision:

‘Decision and publication of the order to lodge a plea pursuant to Article 226(1) of the Code in Article 57a of the Code of Conduct — R.B., and the execution of procedural proceedings with the suspect.’

Both Border defender and Military Gendarmery officers were to be insulted by Bąkiewicz "while and in connection with their duties" at the border crossing.

National Prosecutor's Office, Proc. Przemysław Nowak, confirmed these findings on platform X:

"Regional prosecutor in Szczecin issued on Monday a advice to the territory Attorney's Attorney's Office in Gorzów Wielkopolski to present Robert B. charge of insulting Border defender and Military Żandarmerie officers on 29 June 2025 in Słubice, during and in connection with their duties."

At the same time, however, the spokesperson for the Regional Prosecutor's Office, Małgorzata Wojciechowicz, admitted that the decision was not unanimous:

"The prosecutor, the referee of the case and the deputy territory lawyer in Gorzów Wielkopolski considered that the evidence collected at this phase of the proceedings did not give emergence to a plea. On the another hand, the Regional Prosecutor found that there are grounds for this already.”

According to the Criminal Code, for insulting a public officer is punishable by fines, imprisonment or imprisonment of up to 2 years. The subject himself considered the case an effort at political intimidation.

‘A political decision by the D.A. having no basis in facts. Today, Donald Tusk's government and the D.A. can't find real reasons for stopping me and actually neutralizing my socio-political activities. He will most likely halt me by making specified comic allegations," said Robert Bąkiewicz in an interview with the Polish Press Agency.

In the conversation he besides emphasized his attachment to the Polish uniform:

"I, in my history, undoubtedly cared for the respect for the Polish uniform much more than today's ruling team, and I think that this basis, which is being drawn today, if there are actually neutral courts, it cannot survive."

The events in Słubice took place on 29 June and the investigation was initiated a day later. Bąkiewicz participated at this time in alleged civic patrols within the Border Defence Movement. The ROG website reads:

“We are a nationwide social initiative aimed at defending Poland against mass migration and threats related to it.”
