The government announces its withdrawal from part of the provisions of the amendment of the household Code, which mostly puts people possibly suspected of crimes committed by the margin. It is simply a regulation that any individual in contact with school students must have a certificate of non-criminality obtained in the National Criminal registry and the registry of Criminals on the Sexual Background.

In the Ministry of Justice, a draft amendment to the Kamilka Act was created. According to him, no certificate of non-criminality will be required from parents if, for example, they go to the swimming pool with students or go on a journey – said Deputy Minister of Justice Zuzanna Rudzińska-Bluszcz.

On Thursday, Deputy Adam Bodnar, at the Parliament gathering of the Commission on Children and Youth Affairs, informed that a draft amendment was created in the Ministry of National Education, among others, on the basis of comments submitted by the Ministry of Education.

Rudzińska-Bluszcz stated that the task will include first: the exemption of parents from the work to bring a certificate of non-criminality from the National Criminal Registry, if they participate, for example, in drying hair on the pool or leaving as volunteers for school trips. She added that fees for non-criminal certificates for volunteers should besides be abolished.

We foresee the abolition of double checking of a person – announced the Deputy Minister. She explained that it was about, for example, the situation of a sports coach who had already been checked in the registers by the company. Like she said, the school won't gotta do it again. She besides announced that the rules should be clarified so that it is clear that there is no work for non-criminal certificates to be presented by persons coming to school and from whom there is simply a presumption of non-criminality. An example was given by police officers, lawyers, and the Ombudsman.

In late August, the Ministry of Justice announced that the Kamilka Act would be clarified. In early September, Minister of Education Barbara Nowacka announced that the provisions of the Act would be evaluated. – From October, curators will carry out checks on how these rules work She stressed.

Amendment of the household and Care Code, colloquially referred to as the ‘Kamilka Act’, or lex Kamilek, was passed on 28 July 2023. The stated nonsubjective of the change was to strengthen the strategy protection of children from harm. The fresh regulations came into force on 15 February. Since then, persons taking up employment in institutions connected with the activities mentioned in the Act with children must present a certificate of non-criminality from the National Criminal Registry.

On 15 August, requirements on alleged standards for the protection of minors began to apply – according to experts, this is 1 of the most crucial elements of the bill. They are designed to aid them to see earlier the disturbing signs that a kid may be hurt and respond to them. They must be implemented by all institutions from which the services are utilized by children, including educational institutions (schools, kindergartens), caring, educational, religious, artistic, medical, recreational, sports, related to the improvement of interests.

The bill was prepared after the tragic death of an eight-year-old Kamilka from Częstochowa beaten by his stepfather.
