The Kalisz territory Court reported the impossibility of uncovering an expert who could issue an opinion on complications following vaccination against COVID-19. This concerns a suit filed by a 19-year-old female who demands 201 1000 zloty compensation from the Treasury. A teenager claims that after receiving the vaccine, she experienced neurological complications that had a negative impact on her life, causing her to be “drained, sad, anxious and lonely”.

The civilian process began last December. The suspect is the Treasury – the Minister of Health, represented by the lawyer General of the Republic of Poland, due to his participation in the National Vaccination Programme. The case is behind closed doors at the request of the plaintiff's attorney.

The State Treasury requests that the action be dismissed, indicating that the work for any complications should be considered in the context of another entities specified as the vaccine manufacturer, the medical institution or the individual who administered the preparation. It was besides stressed that vaccination against COVID-19 was entirely voluntary and the National Vaccination Programme, adopted by a resolution of the Council of Ministers, was not the origin of the mostly applicable law, but of an interior nature.

According to Marek Urbaniak, a spokesperson for the Kalisz territory Court, the case was stuck at the phase of establishing experts to find the causal link between the plaintiff's ailments and vaccination. Neither the party's attorneys indicated a candidate as an expert neurologist, nor the technological institute suggested by the State Treasury refused to give an opinion on the matter.

The Court of First Instance considers the case to be ‘exceptionally hard in substance’, requiring medical and legal expertise as well as multi-emergency. An example is the fact that Pfizer itself has 730 A4 pages with highly specialized knowledge.

To date, parties have been consulted and information has been gathered from the Agency for the Registration of Medicinal Products, Medical Products and Biocidal Products. The deficiency of the ability to appoint an expert is now the biggest obstacle to further conduct of proceedings and to find whether there truly is simply a link between vaccination and the ailments of a young woman.

According to the Chief Sanitary Inspectorate, in 2022 12,345 cases of adverse post-vaccination о were reported, of which 2,456 were severe. The National wellness Fund paid in 2022 PLN 14.5 million in compensation for the harm caused by vaccination.

The global wellness Organisation (WHO) recommends that vaccination against COVID-19 be carried out under close supervision and constant monitoring of patients. WHO besides recommends that vaccines be available and free of charge to all those in need.

In Poland, vaccination against COVID-19 is conducted by the National wellness Fund, which provides free vaccinations for all Polish residents. The National Vaccination Programme is implemented by the Ministry of Health, which is liable for coordinating and supervising vaccinations.

It is worth noting that vaccination against COVID-19 is an effective way to prevent diseases and deaths caused by COVID-19. WHO and Centers for illness Control and Prevention (CDC) urge that vaccinations be conducted widely and systematically to minimise the hazard of illness spreading.

In conclusion, the case of compensation for alleged complications after vaccination against COVID-19 is very complex and requires medical and legal expertise. The Kalisz territory Court will gotta carefully consider all the evidence and opinions of experts to issue a fair judgment.
