Antoni Ciszewski: Between Gierty and reality
As usual, the fight for fact and justice in the planet always takes place between Goliath and Bible David. Also prematurely issued by the MP/legalist delict the possible breach of the concordat agreement, in this peculiar case the agreement of 28 July 1993 between the Holy See and the Republic of Poland, Dz. U. 1998 No. 51 item 318, in respect of the failure to respect the rule of independency and autonomy of the Parties by Fr. Rydzyk, is in fact a frontal attack on this clergyman, with the intention of undermining his integrity and dignity in the fulfilment of the priest's ministry.
But on the MP's pursuit he fits in vividly into a model of ideological dictatorship, not taking into account the fundamental legal principles that arise from the law.
One of the basic legal principles is that: The discipline of the law is cognition of divine and human affairs and cognition of what is just and what is unjust.
For a wide scope of Poles, Giertych has long since ceased to be a lawyer (?) under the Bar Ethics and Professional Dignity Collection, called the Code of Bar Ethics, e.g. Article 8 and Article 9Because he is not faithful to these ethical principles as an attorney, he does not refrain from lying suggestions raised by him publically against an innocent person.
Also, the function of a associate of the Polish Parliament, which he presently holds, does not give him any basis for the media stigma of a clergyman, who, after all, full enjoys his civilian rights, which is guaranteed by the Constitution of Poland. In addition, in the case of Fr Rydzyk, his behaviour is in accordance with the law of the Church which he received under priestly ordination.
The public suspicion of this well-known clergyman that his media pastoral ministry as ordained priest may violate the autonomy of the Polish state, is simply a behaviour unworthy of the Polish MP, due to the fact that on the occasion of consciously misleading the public with respect to facts as well as applicable law, in relation to this peculiar case.
Such secular, and non-Catholic, angry outside of Giertych does not take into account the full content of Article 1 of the Concordat Agreement, and to which with specified openness (and legal insight?) is he referring.
Article 1 – The Republic of Poland and the Holy See confirm that the State and the Catholic Church are independent and autonomous and commit to full respecting this rule in their relations and in their cooperation for human improvement and the common good.
According to the causal assumptions of this article in the Concordat agreement, there is inactive a 3rd organization to this agreement, i.e. a man (a Polish citizen), and a common good as the overarching nonsubjective of the cooperation of the Contracting Parties.
Legally, the content of this agreement gives actual meaning hypothesis the legal standard contained in Article 1 which indicates the common work to full respect independency and autonomy
Parties and in line with cooperation in favour of human improvement and the common good; this interaction is just to justify the second component of the legal standard, i.e. disposition – as a lawful action, in accordance with an order or a statutory prohibition; only the 3rd component of the legal standard is sanction, provided for in breach of the terms of the contract, besides for failure to comply with the applicable law in the territory of Poland by either organization in connection with the implementation of the agreement.
Therefore, it is without object that the authorities of the Republic of Poland (and associate and Advocate Giertych is already in particular) and the Holy See, in the framework of the agreement concluded, if this action does not take into account the rule of reciprocity, i.e. does not harm each other, and if it does not aim to cooperate the Parties ...for human improvement and the common good.
There is no deficiency of respect for the autonomy of the Polish state, due to the fact that the state authorities, or the church hierarchy, are not liable for these real works, partially financed by the aid of the Treasury, whose public purposes are educational and spiritual purposes for the full society.
Using the legal terms, it should be pointed out that Law is the ability to apply what is right and right. But the problem for all malcontents is the correct knowing of what justice is. The basic regulation of law states that Justice is an unchanging and enduring will to warrant all 1 of its rights. But it should be stressed that within the limits of this Good and Right, as is the concept of the law itself, which fulfils the constitutional task to guarantee that the public and public institutions of the state can function fairly.
Mr Giertych's public statements show that Fr Rydzyk's most serious charge is to engage his works in political activity, as if it were harmful to democracy, due to the fact that in this way the priest could buy public opinion (?), with the intention of creating negative political sentiments.
The alleged allegation is not realistic, due to the fact that in Radio Maryja and tv information messages There are no educational elements contrary to the teachings of the Church, no content incompatible with the deposit of Catholic faith. There is area for the formation of patriotic attitudes in young people and adults, so that it is possible to rationally measure the situation – besides political and economical – in which modern societies live.
Individual shepherds of the Church must respond to human harm, to threats that harm human wellness and life. This scope of social responsibilities is simply a shared concern for the appropriate improvement of man with his natural predispositions.
At the very least, it can be doubted at the financial strength of the works created by the priests, even if this is simply a godly purpose. However, the actual priest is not known by his vast (and visible) creation.
... The priesthood is the mission of the Most advanced God to execute the most sacred sacraments. The priest is recognized not by works which he creates externally, but after how he prepares for the holy mysteries and how he performs them. His attitude towards the sacraments reveals the fact about how he fulfills his spiritual mission – priestly. Nevertheless, the importance of the educational function of Catholic centres should not be confused, as well as that of priests and bishops, the evangelization mission, as part of the general apostolic teaching, with the propaganda tube, the political strictness, in the appropriate public media by the regime's actuators, in which the ideological discourse, contrary to this, is intentionally and subliminally permitted Good and RightI mean, with the essence of the law in general.
