A blatant image of procedural law and substantive law, 16-year-old state terror, abuse, persistent harassment, humiliation, abuse of power, excess of powers, failure to fulfil obligations, false statements, fraud, against Article 11 § 1 k.w.failure to comply with the work arising from Article 157 § 1 k.p.k..
The objectives of criminal proceedings have been violated (Article 2), the rule of objectivity (Article 4 kp.k.), in dubio pro reo (Article 5(2)(k)), the free assessment of evidence (Article 7 kp.k.), rights of defence (Article 6k.) and the right to a fair trial (Article 6 ECHR).
The victim was deprived of his right to court, to dignity, to repair damage, fundamental right of defence in all stages of proceedings according to Article 42(2) of the Constitution of the Republic of Poland.
Rule of law has been violated (Article 2 of the Constitution of Poland), rules of operation of the national authorities (Article 7 of the Constitution of Poland) and compliance obligations (Article 83 k.p.k.The rule of human dignity (Article 30 of the Constitution of Poland), equal treatment of the citizen (Article 32 of the Constitution of Poland), prohibition of torture and inhuman treatment (Article 40 Constitution of the Republic of Poland).
The good of justice, the seriousness of the court, The Judges' Professional Ethics Principles Collection and the Polish Bill of Victims' Rights, work was transferred from the perpetrator to the victim:
- You can't transfer work for a crime from a perpetrator to a victim. You can't justify crime by tradition, culture, stereotypes that minimize the perpetrator's guilt.

Decision enforced II K 38/19 au Article 216(1) despite the deficiency of a complaint by a legitimate prosecutor and which according Article 439(1)(6), (9) and (11) and Article 17 § 1 points 1 and 9-11 k.p.k. is not and cannot be legal.
Mr Aleksander Żurakowski with a resolution IV Kzw 470/22 ruling in his own faulty case IV Ka 436/20, did not explain the circumstances of the case, did not remove serious doubts, deprived the suspect of his right to vote, showed no copy or extract of the judgement to be enforced, with mention to the enforceability, and, in the case of a final one, on the date of his finality, did not specify the date of finalisation of the judgement II K 38/19 (or on the day 24.09.2020whether on the day 17.12.2020whether on the day 18.01.2023). The order was already issued before the sitting, as the gathering lasted only a minute.
It should be borne in head that, in the order of a justice not empowered in the case, II K 38/19 COMMISSION DECISION of 18 January 2021 correcting ‘an apparent clerical error’ in the judgement II K 38/20, after the appeal court has already pronounced the alleged judgement of first instance on 17 December 2020, designated Grzegorz Niedźwiecki as Indicted not convicted and not instructed to complain.
A criminal offence of unlawful imprisonment involving peculiar torment, i.e. an act with Article 189(3)

Grzegorz Niedźwiecki was politically convicted, commissioned.
