Prime Minister Donald Tusk reportedthat his government adopted on Tuesday a bill allowing the head of the ABW, alternatively than the court, to decide which content on the net is terrorist. By decision of the Head of ABW, they will be removed without a court judgment.
On Tuesday, the government dealt with the draft anti-terrorism act prepared by the Ministry of abroad Affairs, the ABW and the AW Act. The task adapts Polish law to the European Union's rules concerning the prevention of online dissemination of terrorist content. To this end, a mechanics will be introduced for issuing and verifying orders to remove or prevent access to specified content. The Head of the interior safety Agency will be liable for the enforcement of the fresh rules.
– So far, the content on the net that poses a terrorist threat helps organize a terrorist attack, calls for it to see if it was possible to remove various types of attacks on another people only after the court's judgment. However, the task adopted present by the government allows to remove specified content without a judgement – said Prime Minister Donald Tusk during the conference after the government meeting.
He explained that according to the project, "the Head of the ABW will measure which content is terrorist and will be removed by his decision".
– If their authors and owners consider that the reaction was exaggerated, or in their opinion they were not terrorist, they would be able to mention the substance to court – added.
The Prime Minister pointed out that akin regulations had already been adopted in all European countries outside Portugal and Slovenia.
The draft amendment proposes the establishment of the Head of the ABW as the body liable for implementing the Regulation, including the issuing of orders to remove mandatory hosting service providers to remove terrorist content or to prevent access to terrorist content in all associate States.
In addition, the ABW is to verify removal orders issued by the competent authorities of another EU countries and to identify possible infringements in this respect; to extend the retention period of terrorist content which has been removed or accessed by the removal order issued; to issue decisions on hosting service providers exposed to terrorist content and to supervise the implementation of circumstantial measures. yet – impose administrative penalties.
The implementation of the tasks will be carried out by decision in the course of single instance proceedings. At the same time, hosting service providers and content providers for which ABW has issued a removal order will have the right to challenge those decisions before the competent administrative court. The right to lodge a complaint with an administrative court will besides be granted to the hosting service supplier to decide to identify it as a hosting service supplier exposed to terrorist content.
OUR COMMENTS: As expected, the Tusk government is rapidly making up for 8 years, introducing censorship even incomparable with the celebrated ACTA, which he was forced to carry out in 2012.
