In May, the Warsaw territory Court will issue a final judgement in civilian proceedings against Andrzej Duda acting as president of the Republic of Poland. Gerard Weychert demands that Duda apologize to the head of state for violating the regulation of law. Additionally, the suit calls for a press conference on which the president would make an apology statement. Weychert besides demands payment of PLN 1000 as compensation to the territory infirmary in Raciborz.
The proceeding in this case began last Friday before the territory Court in Warsaw. On the same day after the rejection of most of the evidence, the court (we do not know the court's composition, which makes it impossible for us to verify its legality) closed the wire and set the date of publication of the judgement on 23 May. During the trial, the suspect was Andrzej Duda, and he was succeeded by a proxy from the lawyer General.
A suit against Andrew Duda. Reason for regulation of Law
— The court took its views on the case. We sustained the lawsuit's request, the prosecutors upheld the motion to dismiss the lawsuit, and if the court fails to take into account the formal grounds for rejection, they claim that the action be dismissed. The court omitted evidence from expert opinions ad hoc Professors of law we have requested are prof. Andrzej Zoll, prof. Mark Safjan, prof. Andrzej Rzeplinski and prof. Jerzy Stępnia, who reports the plaintiff's attorney.
Gerard Weychert waited for his first trial for almost 4 years, as he filed a suit against the president in July 2020. In his lawsuit, he demands that the president print an apology on his authoritative website for alleged violation of his right to live in a democratic state of law in which the authorities are obliged to comply with the regulation of law principles of both the Constitution and Union law.
— In my client's assessment, through the President's decisions regarding the appointment of double judges to the Constitutional Court as well as changes in the constitutional laws regarding the judiciary, there has been a violation of his right to life in the democratic state of law, where the regulation of law is respected," said the proxy.
In a suit against Duda, a citizen demands an apology and a press conference at which the president would make a public message of apology. Additionally, Weychert besides demands the payment of PLN 1 1000 to the territory infirmary in Raciborz.
Weichert's suit was filed in 2020 to the Rybnik territory Court, which rejected him, recognising that the president could not be held accountable to the general court. However, the Court of Appeals in Katowice had a different opinion and after appealing the plaintiff ordered a suit against the President. The case went to the Warsaw territory court in 2021, and was yet awaited until Friday.
