We are facing the top constitutional crisis

Press conference of Deputy talker of the Parliament Krzysztof Bosak, 12 January 2024.

– We are faced, perhaps, with the biggest systemic conflict, with the constitutional crisis that Poland has experienced for many years. The mistakes made during the PiS regulation period, the conflict between the judicial, political and European Union institutions first caused a crack in the judicial strategy and then escalates to further state bodies. At the moment, it is besides beginning to interfere with our work as members of the Sejm.

We have a situation in which judges do not admit each other's judgments. The judges do not recognise decisions of the ultimate Court, do not recognise circumstantial Chambers, justice twice in the same cases, ignore judgments of the Constitutional Court, besides those judgments given in court without alleged double judges, of whom there are doubts whether they were appointed in accordance with the Constitution. The President's prerogatives are being questioned. besides in cases where the dispute was judged by the Constitutional Court.

What is more, we are in a situation where Members have the order of the talker of the Sejm to extinguish the mandate and we have conflicting ultimate Court judgments as to whether or not the decision remains in force. More simply, at the next session of the Sejm, we are not certain that the Sejm should be sitting with 460 Members, 459 or 458. If the State Election Commission launches the procedure for completing the mandates, possibly the legal state will be that we will have, for example, 461 Members.
At the moment, we have a different legal state for both Members. And in addition, these Members, according to the President, were officially pardoned, in prison.

This situation, aside from the issues of who is right here, weakens our country. This situation weakens our country when, first of all, we are entering a phase of very intense negotiations in the European Union, which is trying to transform, strengthen the degree of federalisation. On the another hand, there is simply a war going on behind our east border.

This situation is compromising our country internationally. This situation disappoints citizens who voted for political peace to return to Poland. So that Poland does not be a country immersed in common struggles and conflicts. And for the regulation of law to return.

The regulation of law cannot be restored by force. The regulation of law cannot be restored by the alleged transitional period, as any publicists call it euphemistly. So we break laws, ignore judgments of the courts, and do what we want due to the fact that we have a majority in the Sejm or power in the power departments.

I would like to appeal to all parties to this dispute to reduce the level of political conflict due to the fact that it will be devastating and as a consequence it will harm not only the full society and the state, but besides the ruling paralysing them of the anticipation of legally carrying out any reforms in the state. ...
