On October 3, the Capital territory Court has a judgement against Marcie Lempart, Krystyna Suchanov and Agnieszka Czerederecka-Fabin – leaders of vulgar, pro-abortion protests, whose participants tried to desecrate Catholic temples. The demonstration took place in autumn and winter 2020 following the judgement of the Constitutional Court, which deleted the alleged eugenic premise from the Act on the Protection of Human Life.
In November 2021, due to the uncovering of “significant deficiencies”, the territory Court in Warsaw decided to return the prosecution's indictment in this case. Again the territory Attorney's Office in Warsaw brought him to court in October 2021. All 3 leaders of the alleged women's strike accused him of "bringing danger to the lives and wellness of many people" and causing an epidemiological threat as demonstrations took place during the sanitary regime.
Marta Lempart was further accused of insulting police officers by spitting on them and directing vulgar words towards them, as well as public commendation of crimes.
The last allegation is related to an interview on Radio Zet of October 2020. In consequence to the leading remark, which, speaking of demonstrations, assessed that “there is no request to enter the church or destruct the facades of church buildings”, Lempart stated: – Of course you do. You gotta do what you feel. What you think and what is effective and what they deserve.
On Thursday at the territory Court in Warsaw, the last witness testified in this case and the court closed the wire, after which the parties gave final speeches.
The Prosecutor's Office pointed out that erstwhile it comes to the action concerning the organisation of the demonstration, the facts of the case are not disputed. She pointed out that although the defendants refused to give explanations at the phase of the preparatory procedure and did not admit to committing the alleged acts, these are reasonably well documented events, among others, in relation to material circulating in the public opinion. – We all remember them. – said Proc. Radosław Jancewicz in the courtroom.
He stressed that the defendants had published material through social media in which they encouraged participation in the demonstrations.
The defender of Clementina Suchanov adw. Krzysztof Stępiński pointed out that the basis of the conviction could be only the full condition which came out during the main hearing.
– The court has to ask itself why women went out on the street. I think it was a kind of moral imperative, categorical... It was an expression of legitimate moral opposition to the dark garden government – said met. Stępiński.
He added that the indictment was not evidence in the case, and in this case he considered it alternatively a "pathological hypocrisy", as on 11 November 2020 the independency March with the participation of nationalists was held.
– No 1 came up with the thought to cancel this cyclical convention and abruptly it turned out that during this convention, where no 1 had a mask, the virus would not multiply. – stressed Mr Stępiński.
He besides pointed out that there were no expert epidemiologists in the case file, so he did not realize the basis on which the prosecutor based the indictment.
– This indictment is based on conjecture. He said.
Another court time was set for October 3. Then the conviction is to be pronounced.
