Only during the first 4 months of that year, officers of the Carpathian Border defender Branch conducted over 2,500 checks on the legality of their stay, resulting in the illegal presence in our country as many as 250 foreigners. In the last 7 days Stop 18 foreigners, citizens: India, Belarus, Azerbaijan, Uzbekistan, Kyrgyzstan, Colombia, Turkey, Georgia, Nepal and Bangladesh. In a nutshell: Poland is shaking under the force of illegal immigrants.
Hundreds of refugees are hiding in Poland. Only on 8 May this year, as a consequence of checks on the legality of abroad residence in the territory of the Republic of Poland, the officers of the Carpathian Border defender Branch issued 3 decisions on the work to return. 1 of the events occurred in Tarnów, where border guards from the local outpost, during regular patrolling of the city streets, selected a foreigner – as it turned out to be a Bangladeshi citizen – who stayed illegally in Poland for 803 days.
A man worked regular in gastronomy in Poznań, and yesterday he went to visit friends and before reaching them, he fell into the hands of Borderers. The SG Office in Tarnów left with the decision to return, with the simultaneous ban on re-entry into Poland and the Schengen area for six months.
Officers from the SG Office in Kielce checked the Indian citizen in turn. He did not have the right to stay in our country and illegally crossed the border from Slovakia to Poland, where he reached through Dubai and Romania.
The same day in Starachowice another SG patrol stopped 45-year-old Georgian, who stayed illegally in our country for 647 days. Both cases ended with a decision to commit to return and ban entry into Poland and the Schengen area for a period of 6 months.
What is the commitment to return?
The basis for specified decisions is Foreigners Act of 12 December 2013 (i.e. OJ of 2020 item 35).
The decision to oblige the foreigner to return shall specify the date of voluntary departure, which shall be between 8 and 30 days, calculated from the date of transportation of the decision. This decision is recorded in the abroad passport. The authority which issued the decision to oblige the foreigner to return shall inform the foreigner in writing in a language which he understands about the legal basis for the decision, and shall instruct him whether and in what manner he is to be appealed against that decision.
The period of voluntary departure shall not be indicated where a foreigner is likely to escape or the defence or safety of the State or the protection of safety and public order so requires. That decision shall be immediately implemented.
In practice, illegal immigrants and those who remained in Poland after the word of their temporary stay (e.g. an worker visa) and were caught by the service do not return to their homelands. After receiving their return commitment, they hide in the country or go to another EU countries where they apply for asylum. Then, they are expelled to Poland on a Dublin procedure. Anyway, I legalize in Europe permanently.
