The territory Attorney's Office in Lublin dismissed an investigation into the impact of the AIM-9X rocket launched from the F-35 fighter in a home in Wyryka-Wola on September 10, 2025. She felt that the commanders and soldiers were legally active while resisting Russian drones. No 1 has been injured, but the decision does not relieve the State of the work to full settle the damage.
No criminal record
The D.A. dismissed the proceedings due to deficiency of criminal record. Investigators established that the Operation Commander of the Armed Forces Types and Pilots performed duties under the law and the Constitution of Poland. The order to neutralize the drones was to be issued in accordance with procedures, with the overriding intent of protecting the lives of people.
According to the explanatory memorandum, action within the limits of his duties excluded the illegality of the act. The prosecution considered the harm to Wyryka-Woli as a side effect of military consequence to the immediate threat of the State. This ruling concerns the criminal work of soldiers. It does not mean that the harm suffered by residents becomes their private problem.
AIM-9X rocket hit the building
The incidental occurred on the night of 9th to 10th September 2025, erstwhile Russian drones repeatedly breached Polish airspace. This incidental was 1 of the most serious signals that Russian force on Polish territory has a real dimension. The answer was military operations and orders to destruct incoming objects.
During its course, the AIM-9X Sidewinder Block II missile, launched by pilot of the F-35 fighter, inadvertently struck the roof of the home in Wyryka-Woli. The opinion of the Military Police Crime laboratory indicated that the direct origin of the harm was the detonation of the warhead after the rocket's contact with the building.
The home was badly damaged. The harm besides included an economical building, neighbouring buildings and 2 passenger cars. no of the residents were injured. In the course of the investigation were inspected, traces were secured, surveillance was analysed and the victims and witnesses were questioned.
The evidence besides included the command documentation and evidence of the on-call air defence commander. They were expected to confirm that the shot was fired on a clear order given under procedures to defend human aggregates. This item is important. The D.A. did not consider hitting the home as a trivial event, but assessed the behaviour of circumstantial people in an emergency.
The military must defend, the state must answer
The Polish military has a work to respond erstwhile abroad unmanneds invade our territory. Passivity would be an agreement to test Polish defence with impunity. Another alarm in the east of the country they show that it is not a theoretical or a one-time threat.
The resignation of the investigation closes the criminal evaluation of the described action, but does not exhaust the state's work to citizens. Residents cannot bear the cost of an operation conducted in the interests of the full country. Regardless of procedures and military rations, they request to be able to correct the harm and clear information about the findings.
For Poland the rate is clear. Air defence must act rapidly and effectively and institutions must take fair work for the consequences of their decisions. The trust of citizens towards the state is built only when, after the alarm has been completed, the victims are left alone.
