Yesterday, on 22 May this year, the Constitutional Court ruled that Barbara Nowacka's decree concerning the non-counting of religion in the average grades in schools is incompatible with the Constitution, the Concordate and the Act on the Education System. This is simply a major defeat of the coalition revolutionaries, who are going to push religion out of schools.
The failure of the far left on spiritual lessons. On Thursday, the Constitutional Court recognised the PiS Group's request to learn this subject in schools. The regulation was issued by Minister Barbara Nowack last year.
On the basis of the judgment, the president of the Constitutional Tribunal Bogdan Święczkowski explained that if the assessment of religion ceases to be treated in the same way as those of another subjects and thus ceases to be applicable to the full average and content of the certificate, this means a change in the way in which the tasks related to its teaching are carried out.
The president of the Constitutional Tribunal stressed that these changes were implemented without the agreement required by the Act on the education strategy with the authorities of the Catholic Church and the Polish Autokephal Orthodox Church and another Churches and spiritual Unions. According to him, it was insufficient to get in the public consultation a negative opinion of the committee of Catholic education of the KEP, especially since it was not taken into account in any way and the changes were pushed through by the knee. The provisions of the Constitution and the concordat, or global agreement, have so been clearly infringed.
"This judgement removes from the legal strategy the effect of the controlled regulation of 22 March 2024, which is not to include an assessment from spiritual lessons to average assessments" — added in the Communication following the judgement of the Constitutional Tribunal.
On the inclusion of spiritual assessments in the average, the Constitutional Court had already spoken in 2009, following a request from left-wing Members. The judges besides felt that the inclusion of spiritual marks in the average was in line with the basic law.
