Emilia Sz. ex-wife of a justice who applied for asylum in Belarus, will hear a charge in connection with the “hate affair” of the KAST Group

The Prosecutor's Office in Wrocław issued a resolution to present charges against Emilia Sz., 1 of the central figures in the hatred speech in the Ministry of Justice and the erstwhile wife of justice Tomasz Szmydt, who left the country and is now in Belarus. For the moment, investigators don't uncover the details of the charges. According to the information of the Polish Press Agency, Emilia Sz., besides known as “Little Emi”, has not yet been informed of the content of the charges against her.

The Wrocław prosecution has set up a peculiar squad to analyse the hatred crime.

The Wrocław prosecutor's office established a squad to conduct an investigation of the hatred crime which was frozen during the regulation of the Law and Justice.

"The procedure is being conducted on the breach of powers by public officers acting in the Ministry of Justice, in peculiar through unacceptable processing of individual data, thereby harming the public and private interest", said the Public Prosecutor Anna Zimoląg.

There is presently no information on the circumstantial allegations to be made by Emilia Sz., and investigators do not disclose their content. The prosecution, represented by prosecutor Zimoląg, confirmed that Tomasz Szmydt, Emilia's ex-husband, is presently not active in the proceedings, no charges are made against him.

During a press conference in Minsk, justice Tomasz Szmydt of the Provincial Administrative Court announced his request for asylum and protection from the Belarusian regime. This information was provided by the WSA spokesperson, Małgorzata Jarecka, who stressed that the authorities of the court did not have any additional information on this request or a message of resignation of the judge. The announcement issued by the court explains that between 22 April and 10 May, justice Szmydt is on vacation.

‘Little Emi’: I did it due to the fact that I thought that was what love was all about.

Tomasz Szmydt appeared at a conference at the Belarusian state agency BielTa, where he formally applied for dismissal from the service at the WSA, asked the Belarusian authorities to grant protection and called on the Polish authorities to resume dialog with Belarus and Russia.

Tomasz Szmydt was 1 of the key participants of the alleged hatred speech in the Ministry of Justice, where he admitted to taking part in attacking judges on social media who opposed the reforms of the judiciary introduced by the ministry under the direction of Zbigniew Ziobry. His then wife, Emilia Sz., besides participated in these activities.

– I did it due to the fact that I thought that was love. That I aid those who want to clear their environment of evil people. My husband needed this activity to get higher, so I was able to do specified terrible things," said Sh. in a conversation with TVN's “Note” in September 2022. – In our group [changed online ideas to slander judges critical of PiS – ed.] were almost the judges themselves, and the prosecutor supervised it. I didn't realize what I was doing – she said.
