I know, I know, you are not among the regular commentators on this blog – due to the fact that you are rather right to fear that I will cut your comments. I'll do it now, too, if you go with your rudes to "Poles of the Worse Sort". But possibly any part of you is secretly reading it, just as I am reviewing your blogs.
Look, I realize and share your distrust of judicial power in Poland. On our side, many people besides believe that the justice strategy is 1 of the biggest failures of the 3rd Republic (the latest book sensation here is after all book Lazarevich about the unsuccessful trial of the oppressors of Przemik).
We are critical of the various decisions of the Constitutional Court from the past. We resent the Platform's notorious stalling in bringing these judgments into force (for me it was a unique scandal to tolerate the unconstitutionality of the Union Act).
Many of us would applaud the sensible proposals of the Law and Justices aimed at improving the functioning of the courts or even the Court. Only that what the Law and Justice did in this case is to repair the microscope with a hammer – even if the image was weak and blurry before, it would not get better.
On your side, from what I can see, there is simply a tendency to bring this into the individual conflict ("and due to the fact that this Rzepinski looks sick at) or political 1 ("and due to the fact that the Platform started and the Venice Commission stood by it"). As if the malfunctioning microscope would only become functional due to the fact that a sympathetic politician from a sympathetic organization would usage it.
It is our belief that there must be a court ruling the conformity of the law with the Constitution and that it must be independent of the president and the parliamentary majority. He does not request to be called the “Constitutional Tribunal”, delight let him be called the “Constitutional Chamber of the ultimate Court” or even “Erem Merem Tytyric”, that is secondary details.
This independency is crucial. The written proposal – that is, this hammer to fix the microscope – is the Court dependent on the president and Parliament. It doesn't make sense. A control function cannot be performed by a controlled person.
The proposal of the Law and Justice will so not be accepted by the US or the European Union, our most crucial allies. He may receive applause in Budapest, most likely Moscow, Minsk, Dushanbe or another Tashkent, but not Brussels and not Washington.
"The Venice Commission is not an authority for me" – written bloggers declare. And great, the authorities all have different, but the problem remains that it is not blogger writers who distribute EU funds.
All indications indicate that the dispute over the tribunal is moving towards EU sanctions. Fixing the microscope with a hammer doesn't get so much fun erstwhile the repairer gets fined for destroying property.
EU sanctions will block many elements of the "good change" you hoped for by choosing this hammer sovereign. The budget gap will no longer rise the tax-free amount or reduce the retirement age. Morawiecki's plan will should be postponed.
What precisely are you hoping for? That you can convince the West that your proposals do not violate the rule of the independency of the Constitutional Court? OK, any of you may have been so delusional erstwhile the regime's media told you about the success of Szydło in Europarlamenta and how good the representatives of the Venice Commission talked to our authorities.
It's over. So what now? Discrediting the Commission for being leftist, platformer, bike and vegetarian? That if she committed a leak, she compromised herself?
These are arguments that can work in an enchanted ellipse of writers supporting another writers. Ziemkiewicz will retweet Gmyz spreading Warzecha, and the same commentators as usual will do the same horn as usual.
But you must be aware that this argument is not adequate in Brussels, Strasbourg or Washington. Worse still, aggressive statements by government representatives specified as the President's fresh pin and over-premise do not facilitate diplomatic efforts to ease the situation (not to mention whether Waszczykowski could mitigate anything).
So what's it like with you guys? Are you counting on the West to be appeased? How about the another way around, bury and scream? How about erstwhile again, erstwhile Szydło assures them that everything's OK, they'll truly believe her this time?
If any of you can answer that question in a cultural way, I promise I won't remove it. I'm truly curious!
