The territory Prosecutor's Office in Warsaw sent an indictment against Mr Grzegorz Braun to the court on 4 November 2026 on 4 acts of 2025. It is about taking 2 flags, destroying 10 boards of LGBT exhibition in the Sejm and the charge of defamation of the organizers of the action "Windkile". Guilty will be settled.

Four actions under indictment

As shown by Communication from the territory Attorney's Office in Warsaw, the indictment includes 4 acts. The first concerns the ban of Ukraine's flag from the balcony of the city office in Biała Podlaska on 30 April 2025. Its value is set at PLN 20. The D.A. qualifies this as a peculiarly audacious robbery.

The second allegation concerns the European Union flag taken on 6 May 2025 from the lobby of the Ministry of manufacture in Katowice. The value of property indicated by investigators is PLN 388. Roman Fritz, a associate of the Confederation of the Polish Crown, was besides accused in this part.

The 3rd act took place on 11 June 2025 in the Sejm. According to the prosecution, Braun destroyed 10 boards of an exhibition dedicated to LGBT people, causing a failure valued at PLN 3690. The charge was based on Article 288 paragraph 1 of the Criminal Code concerning the demolition of property.

The 4th plea refers to statements from the presidential debate on 28 April 2025. The Public Prosecutor's Office considered the word utilized by Braun for the action “Windkile” to defame the Museum of the past of Polish Jews Polin and another organizers of the project. This is about Article 212 of the Penal Code. Investigators have taken up this act in public pursuit, citing social interest.

The indictment is not a sentence

Grzegorz Braun is accused, but he has not been convicted in this matter. The burden of proving guilt lies with the accuser, and the work will be decided by an independent court. This rule must besides apply erstwhile a politician is emotional and chooses sharp forms of public action.

The dispute over the presence of the flag of Ukraine at the Polish office, EU symbols in the ministry or ideological exhibition in the Sejm building is politically justified. Poles have all right to ask why state institutions display specified symbols and who their presence serves. However, the right to object does not mean an automatic right to take or destruct another persons' property. This border is now to be judged on the basis of evidence, not organization sympathy.

The another border is equally important. Criminal proceedings must not become a tool to suppress political criticism. The charge of defamation concerning the speech in the electoral debate requires peculiar consideration, as Article 212 has been a point of freedom of speech for years. The Court should precisely separate the assessment of the legality of the acts from the assessment of the views of the Euro MP.

Immunity revoked, separate process ongoing

The European Parliament waived Braun's immunity in March 2026. The procedure was preceded by request for approval to bring the Euro MP to account. In addition to Braun and Fritz, 4 another people were charged with the prosecution's engagement or assistance in taking the flag of Ukraine.

Before the territory Court for Warsaw-Prague-South there is already a separate Braun trial concerning earlier events, including the extinguishing of Khanuk candles in the Sejm in December 2023. We wrote about 1 of the trials on the occasion. demonstration before the Warsaw court. Both cases should be dealt with separately.

The stakes for Poland are simple: the state is to defend property and legal order, but it cannot punish for itself opposition to dominant ideology. A politician is not above the law. Neither is the prosecution above the work of impartiality. The judgement is to be based on evidence and regulations, not on media force or the political request of the moment.
