Complaint and request for audit and closure of the Delenia Góra Investigation Arrest
in connection with violations of fundamental human rights, the deficiency of a rehabilitation programme, the deprivation of the right of defence in all stages of proceedings, the direct danger of failure of life or severe harm to health, violations of regulations, implementing law and European Union law.
On 21 April 2023, the undersigned Grzegorz Niedźwiecki, boy of Antoni, was illegally detained by police officers and unlawfully imprisoned in the Jelenia Góra Investigation Arrest. It was interned on the basis of a non-existent physical and legal basis of the judgement of the Legnica territory Court of 24 September 2020 on alphanumerical marking II K 38/19. Criminal police officers from Jelenia Góra committed gang violence, breached private property by entering a property at 19 Działkowicza Street in Jelenia Góra. They didn't have court clearance to search the house, forced their ft into the door. The police did not execute the work resulting from Article 244(3), they did not give the detained Grzegorz Niedźwiecki information about their rights and did not service the detained copy of the detention protocol. On 17 May 2023 he delivered a draft detention protocol without a BOLO approved by the Warden – asp. art. Tomasz Szywala Deputy Chief of the Urban Police of the DCI. Richard Figura.
The territory Court has weighed the following:
However, at present in connection with the imprisonment of Grzegorz
The application for a
postponement of enforcement – review of appeal
contested by Grzegorz Niedźwiecki on the time it was taken.
This complaint is not justified.
– specified a provision IV Kzw 107/23 issued SSO Aleksander Żurakowski on 26 April 2023 this shows why the officers circumvented the law and without formal command ordered Grzegorz Niedźwiecki to be abducted.
Investigative arrest in Jelenia Góra did not have legal judicial writings, according to Article 11 k.k.w. a copy or an extract of the judgement to be enforced, with mention to the enforceability and, in the case of a final judgment, with the date of its finality. The court shall forward the decision, together with the reasons, to the manager of the prison or detention centre, if it has been drawn up and does not contain classified information ‘secret’ or ‘closely secret’.
Used as authentic false sentence Legnica territory Court of 24 September 2020 from the first II K 38/20.
Article 270. Counterfeiting and usage of a document
- 1. Who, in order to be utilized as authentic, counterfeits or remakes a paper or specified paper as authentic, is subject to fine, imprisonment or imprisonment from 3 months to 5 years.
Supreme Court order of 31 August 2018 (I CSK 300/18)
The judgment, the operative part of which has not been signed by the composition of the court, does not be in the legal sense (sententia non existens). Since the signatures of the judges are an indication of the conformity contained in the operative part of the decision with their wishes and the result of the deliberations, the absence of signatures, which is not enforceable in any procedural way provided by the law, constitutes a defect so crucial that it deprives the judgement of legal existence.
A judgement given in criminal proceedings (its operative part) must be signed by all members of the decision-making body, regardless of their signature under the grounds for specified a ruling and the absence of at least 1 signature causes it to be affected by an absolute appeal (Article 439(1), point (6) of the NCP).

Grzegorz Niedźwiecki was deprived of the right to lodge a complaint for detention, to study a crime, to contact a lawyer and family, to send procedural papers. The execution of the delusional conviction was not suspended due to the work of caring for a ninety-year-old parent and the severe wellness condition of the intern, even though the lawyer supported the complaint. He was interrupted by physiotherapist recovery and medical appointments in cardiologist, urologist and neurologist. He lost his paid rehabilitation in physiotherapist and the appointment of appointments to Osteocytes on physical therapy. Not even a sick parent was visited inmate Antonina Niedźwiecka to see if she had the means of surviving and the essential life support (Article 160. hazard of failure of life or serious injury).
As shortly as the bars in Jelenia Góra are closed, man becomes nothing. Especially erstwhile he's not carrying any cash. Police and prison service are a drip of political justice.
The investigation arrest in Jelenia Góra is in a state of mourning. The walls are scratched, cracked, dirty, electrical sockets unscrewed, broken, lamps in a moist bath hang on wires. It threatens construction disaster and a serious threat to life. In addition, signs of sphincter, bronchitis, and another skin diseases, viruses, appear in the extermination camp.
The inmates only have an hr walk outside, while the remaining time is spent in a dark, three-man cell, ca 8 m2, with a smoky blind (window). No contact with the world. They sleep on bunk bunks, covered in seed cells and a blanket to cover. There are sometimes missing mirrors, chairs and tables in the cell.
At the time of the meal, there are various excesses, exchange trades between the prisoners in front of the wards. Like a watch for 4 packs of cigarettes. A deluded donor under stress resortes to suicide by swallowing permanent items and goes to the hospital, and then the cayphus comes for the things of the “dead”. If there was order, it wouldn't have happened.
It should be borne in head that the majority of the inmates, the large people, the vast majority, have a good character, regrets that she has strayed, declares that she will not return to the incorrect path. Hi, I'm certain she's been put in jail due to a mistrial. The good character of these people is demonstrated by the fact that they are very helpful, helpful and delicate to human harm, sharing their goods with others in prison. Unfortunately, the Polish state does not support them in the implementation of the principles of social justice, principles of social coexistence, it does not fulfil the work to respect and defend the natural and inalienable dignity of man. No institution RESOCIATION. No serious therapy, no counseling, no future-building tips. If the shell soaks, it will produce fruit.
Let us now decision on to the most crucial issue, the feeding of adult men.
Food rations do not meet EU standards, adequate food values, both in terms of the proportion of nutrients, essential calories, kind of diet and vitamins. The inmates live under conditions of demeaning dignity.
For breakfast and dinner, they service as a dog bread with military melon or marmalade and a drinking lure. They usually service hydrate and soy grits with sauce for dinner. No vegetables, no fruit. Sporadicly tarted carrots. Hunger portions.
For 2 weeks in prison, I lost 5 kg. After 2 years, I would look like a prisoner at Auschwitz.
If that's not enough, it's the employees of the Delenia Mountain Investigation Arrest. They stole a force measuring apparatus from an embedded road.
It is besides affected Polish Victim's Rights Charter – prepared by the Ministry of Justice in cooperation with governmental and non-governmental institutions and organisations, announced in October 1999 a summary of existing rights the victims of crime.

Jelenia Góra Branch Investigative Arrest complained about the transport to Zaręba Penitentiary that I had not passed the dishwashing cloth to the warehouse and that I should be reprimanded. I answered that I was an amateur, that it was a cliché, that I left a washcloth upstairs in a cell under the sink and I could bring it, and the officer wrote that it was only a failure of PLN 3.70 and that it would save costs. erstwhile they let me out of Zaręba prison, they didn't release a force measuring apparatus from my warehouse. They said he wasn't in transport from the Deer Mountain Investigation Arrest. erstwhile I got home, I went to the Deer Mountain Investigation Arrest to claim my property. On 1 day, they said the warehouse was jammed, and on the another day, they didn't find that force gauge. So I ask who and what entry should be or what punishment for misappropriation of property worth PLN 100?
For the humiliation, humiliation, repression, unlawful imprisonment and theft of the inmate manager of the Detention Arrest in Jelenia Góra should be cancelled.
W The Zaręba Penitentiary is diametrically different, better conditions for prisoners as regards the freedom of man and of the citizen and the attitude of the prison service to the inmates, except, of course, the deficiency of real RESOCIATION prisoners and scandalous food rations. This should be changed. The prisoner's a man, too.
The internment continued on 21/04.2023. – 04.05.2023
