The Katowice D.A. dismissed an investigation into medical errors that would have contributed to the death of 37-year-old Agnieszka from Czestochowa. A duplicate pregnant female died in early 2022 as a consequence of complications after her 2 unborn children died. Abortive environments have argued that this case confirms that protecting unborn life leads to ignoring and endangering a woman’s health. The collection authorities investigating this aspect ruled that no irregularities had occurred. That's another verdict after the Ombudsman's ruling.
Based on the advice of a squad of experts, investigators concluded that the conduct of healthcare professionals taking care of Agnieszka was correct, adequate and appropriate to the patient's clinical situation.
On Monday the PAP spokesperson for the Regional Public Prosecutor's Office in Katowice Michał Binkiewicz confirmed that the investigation was terminated. Decision became final on 17 August – The order was not contested by the victims and by the victim’s attorney – added Proc. Binkiewicz.
The death of Agnieszka from Częstochowa, like the death of 30-year-old Isabella from Pszczyna, was recalled in the public debate on the current protection of unborn children. 37-year-old died at the infirmary on 25 January 2022. Children conceived died in about 12 weeks of pregnancy, a fewer weeks earlier. The female was treated at the Municipal infirmary of Czestochowa, Provincial Specialist Hospital. The Blessed Virgin Mary in Czestochowa and in the infirmary in the Pod Częstochowa Blachownia.
Investigators analyzed the patient's treatment process at all these facilities. The case was besides dealt with by a national consultant on obstetrics and gynaecology and patient rights spokesperson. 1 of the key evidence in the investigation was a fewer 100 pages of opinion prepared by experts in the field of obstetrics and gynecology, interior diseases and neurology.
– The grounds for the cancellation of the investigation were that the behaviour of medical personnel of subsequent medical facilities did not include signs of prohibited acts involving the vulnerability of pregnant and duplicate foetuses to the direct danger of failure of life or severe injury to wellness and manslaughter – said Proc. Binkiewicz.
He added that the findings in the investigation were based on witness testimony, medical documentation and the opinion of an interdisciplinary squad of experts.
– The experts considered that medical management was normal, adequate and appropriate to the patient's clinical situation. Appropriately, the operational activities were abandoned and the therapeutic capacity was decently assessed – described Proc. Binkiewicz.
The opinion stressed that care of the pregnant female and her clinical condition were decently diagnosed during subsequent hospitalizations and that clinical problems were adequately addressed.
– As the experts argue, it convinces that medical personnel are aware of the anticipation of worsening the patient’s condition and so take action to reduce the hazard to her life and wellness – added the D.A.'s spokesman.
According to information provided shortly after Agnieszka's death by the deceased's family, the female went to infirmary on 21 December 2021, being in the first trimester of a duplicate pregnancy. Pregnancy ended on December 31. The female died on January 25. She was treated in 3 hospitals in her last life. According to information from 1 of these facilities in the last weeks of her life, she's confirmed a coronavirus infection... after 2 erstwhile negative tests. Many commentators believe that the method of investigating is not reliable.
At the first phase of the investigation, medical records were secured and witnesses were questioned, including the husband and sister of the deceased. The twins were besides exhumed to find the origin of their death. An autopsy was performed on the body of deceased Agnieszka and twins.
Just after the tragedy, a 37-year-old sister made a message about her death on behalf of her family.
"My sister died in the infirmary after spending more than a period there. She was pregnant with a twin. erstwhile 1 fetus died in December, Agnieszka's husband – and my brother-in-law – begged doctors to save his wife, even at the cost of pregnancy. Agnes had a dead fetus for a week. Until the another 1 died. Both were extracted 2 days after their death," she described.
She added that her sister was inactive very sick and had an elevated CRP or inflammation rate in her body. As she stated, the household needs justice and will look for it.
A message in this case was besides issued by the Provincial Specialist infirmary of the Blessed Virgin Mary, where the female was hospitalized in gynecology and obstetrics wards and neurology.
"After the death of the first kid (December 23, 2021), a waiting position was adopted due to the fact that there was a chance to save the second child. In spite of the efforts of doctors, the another 1 besides died... An immediate decision was made to end the pregnancy. Doctors began mechanical and pharmacological induction. Despite the above mentioned measures, there was no consequence from the patient in the form of cervical and uterine contractions. On 31.12.21 it became possible to execute a miscarriage," the manager wrote.
The infirmary besides reported that the female had been tested 3 times on COVID-19 in fresh weeks, the first 2 results were negative, the last – positive.
"The patient's condition deteriorated all the time. The doctors took all possible measures to save the patient" - assured representatives of the Czestochowa hospital.
