Donald Tusk's government is about to introduce a bill to the Sejm banning “talk of hatred”. It besides means a ban on criticism of sex ideology or the political postulates of LGBT activists including homounion and homosexual adoption. The provisions written in Adam Bodnar's ministry are just the first step towards modern and universal censorship. The work of the European Citizens' Panel established in the EU ended in May. It proposed that the Union implement artificial intelligence mechanisms that will identify "hateful content" before their publication, that is, at the time of their introduction on the computer's keyboard.

Ideological censorship under the pretext of fighting “the speech of hatred”

Punishments for the “talk of hatred” may besides await anyone who rejects the usage of names and pronouns incompatible with the real sex. It is not excluded that the tragedy of flooding will be utilized to adopt the task without a real debate, erstwhile the attention of the media and the full society is directed towards the victims of the cataclysm.

Thanks to the mobilisation of society, freedom of expression has late been protected in Ireland, where the government has been pushing government providing for prison sentences for... involuntary possession of hateful content.

During the flood, the Tusk government has already shown that it will not hesitate to prosecute citizens for criticizing power. A 22-year-old girl was detained who complained on social media that after flooded towns “armed looters are coming, people are afraid to go out with dogs, deficiency of police, troops, dense equipment, primarily state aid.” The boy was arrested on ridiculous charges... "enhancement of rescue action".

EU wants to monitor the net in real time

The provisions written in Adam Bodnar's ministry are just the first step towards modern and universal censorship. In May, the work of the "European Citizens' Panel" set up in the EU, where randomly elected citizens of 27 countries, under the watchful eye of officials, prepared 21 recommendations for "the tracking of hatred in society".

It was proposed there.to guarantee that the EU implements artificial intelligence mechanisms that identify "hateful content" before they are published, that is, erstwhile they are placed on the computer's keyboard. Automatic mechanisms will block the publication of an unauthorised entry, and if the prohibited content is published anyway, they will automatically notify the European Public Prosecutor's Office, due to the fact that "talk of hatred" is to be a crime prosecuted over national countries. Recommendations besides include the submission of all EU children to “avoidance of hatred” courses before the age of 8.

Adam Bodnar implements EU Censorical Recommendations

The recommendations of the European Citizens' Panel are not theoretically binding. However, in practice they are already being implemented. On 27 June, the Polish government agreed to the European Commission's “Strategic Agenda 2024-2029” which provides, among another things, for the fight against “disinformation” and “the speech of hatred”. At the same time, Adam Bodnar created a peculiar government “Team to Prevent hatred speech”, among his members was Prof. Michał Bilewicz, who considers the anti-Semitic (and so hateful) even... satirical drawings of Caesar Krishna.

The recommendations are implemented not only by Adam Bodnar. Spain's left-wing Prime Minister Pedro Sanchez referred to them, announcing a statutory fight against fake news. What's distinctive is that the fresh law would only apply to private independent media, due to the fact that government officials clearly say the truth...

How does the fight against “the speech of hatred” look in the West?

Drakonian punishments for "inciting hatred" already endanger in Scotland, where the fresh law considers it a crime of appropriately unwanted pronouns and names to declare 1 of hundreds of "sex". Although the bill was protested by author J. K. Rowling, comedian R. Atkinson, and even Elon Musk, from April any guilty “hate” could go to prison for up to 7 years.

The punishment for utilizing an undefinite “hate speech” is constantly accompanied by initiatives to combat “disinformation” and “fake news”, in fact meaning the control of the press, electronic media and our freedom of speech. Interestingly, in a broad definition of prohibited “fake news” is besides placed the alleged “malinformation”, that is, the actual information(!), but by the power-appointed “verifiers” deemed to be... harmful.

In this context, it is worth mentioning that the European Union Commissioner for the Thierry Breton Common marketplace published an authoritative letter, in which he threatened Elon Musk, owner of the X portal (Twitter), with negative consequences for publishing an interview with Donald Trump.

What amendment to the penal code does Minister Bodnar want?

For now, the government in Warsaw wants to conviction up to 3 years of imprisonment for “invoking hatred” due to “sexual orientation or sex identity” and for “insulting groups of people or individuals due to their (...) sexual orientation or sex identity”. Let's not be delusional. The adoption of even specified a drastic amendment of the Criminal Code will not satisfy the radicals. This will only be a step towards ideological censorship, in line with EU guidelines.

Christians, journalists, scientists, clergymen and social activists will be the first victims of censorship. Eventually, the victims of repression will be average people who will be thrown into prison for their erstwhile spiritual or social beliefs. If penalties can be provided even for inadvertently having hateful content or for trying to enter prohibited words in a Facebook entry, the more the sending of our newsletter becomes a subversive activity.

Ordo Iuris v. censorship

The function of Ordo Iuris in this situation is to thwart the government's plans for the undetected implementation of the Censorial Act. To this end, we are taking a number of concrete analytical and public opinion-mobilising actions, journalists and opinion leaders.

In defence of freedom of speech and freedom of the press, we established an alliance with the Press Freedom Monitoring Centre of the Association of Polish Journalists. A fewer days ago, we organized together. debate on threats related to “the speech of hatred”, whose starting point was the book by Mr Dorosiński. Together with journalists, we are besides preparing a study in which we will discuss examples of violations of media freedom, which occurred in Poland recently.

We are constantly monitoring the work of the government, parliament and EU bodies. We've given up critical analysis Legislative proposals by Minister Bodnar. The consequence is simply a position sent to the Members, in which we have, inter alia, pointed out that the draft amendments to the Criminal Code rise serious doubts as to compliance with Article 54 of the Constitution, which "ensures the freedom of expression for everyone".

As shortly as the draft is in session of the Sejm, we must carry out an efficient mobilisation of the defenders of freedom of speech and block its acceptance.
