Standards for the protection of minors more crucial than the salvation of souls? The Strong Words of a Lawyer

The standards of protection of minors and their implementation for the service of the Church were the subject of a discussion with Agnieszka Zdanowska's lawyer. The expert points to the shocking consequences of putting them above the objectives of the Church contained in the conventional Catechism of the Church.

On air, PCh24TV red. Paweł Chmielewski spoke to Agnieszka Zdanowska, a lawyer and erstwhile associate of the kid Rights Ombudsman Nicholas Pawlak. The discussion focused, among another things, on the standards of protection for minors and the provisions contained in the alleged ‘Kamilka Act’, which are fundamentally intended to defend children and minors. However, their implementation in the Church leads to any absurdities.

Already at the beginning of the interview, the expert stressed that in her erstwhile work in the office of the Ombudsman for Children's Rights she was confronted with cases of abuse against children from priests. However, most of these were marginal and inflated media cases in which it was hard to find any crime against children.

Agnieszka Zdanowska then pointed out that the late promoted standards for the protection of minors were nothing new, as a large part of these provisions already functioned in the 2016 penal code. Moreover, according to an expert in standards, there is simply a kind of blur, not clarification.

However, the most crucial component of the discussion was the implementation of standards in the activities of the Church. Agnieszka Zdanowska pointed out that there was a form of protection of children and young people from any abuses in pre-worker's teaching of the Church. Unfortunately, after the Second Vatican Council, democratisation and departure from the conventional knowing of the concept of "soul-paste" took place. This causes – according to the lawyer – any kind of threat.

The expert added that the post-compulsory improvement of structures appearing in church structures is to blame. Zdanowska recalls the 1917 Canonical Code, as well as the process of democratisation of the Church after the Second Vatican Council.

– How do we scope out [...] to the teaching contained in Catholic catechism? Gasparri, to teach Pope Pius X, we have a very simple definition of what pastoral work is. Now, in the standards of protection of minors in 1 parish, we read that the parish is an individual who is expected to care for the intellectual and physical welfare of children – it points to worrying changes of Zdanowska.

He stresses that the post-compulsory change in the form of pastoral ministry is unfortunately the origin of any abuse. It reminds us that erstwhile the intent of the Church was to fight for the salvation of souls, and present the goal is to evangelize.

The lawyer adds that now standards regulate pastoral work in the Church, which is simply a reversal of phenomena. – If the law introducing protection standards regulates the planning of pastoral work, how is pastoral work understood? This is simply a reversal of order. Standards are a set of principles that will constitute the centre of the value of each institution, including the institution of the Catholic Church," Zdanowska emphasises.

– If the standards of protection of minors are to constitute the warp of the values of the Catholic Church, then the state itself sees unwarrantedness and this humanocentric spirit – he points out.
