Adam Niedzielski convicted of disclosing medical data. The prosecution will not appeal

The prosecution will not appeal the judgement of the court which sentenced erstwhile wellness minister Adam Sundzielski on Friday to 3 months in prison for 2 years for disclosing delicate medical data. Doctor Peter Pisula found the conviction satisfactory.

On Friday, the territory court for the capital city of Warsaw sentenced the Minister of wellness Adam Niedzielski to 3 months of imprisonment in suspension for 2 years and to release the conviction to the public. The erstwhile Minister of wellness is besides expected to pay PLN 5 1000 in damages and to cover the costs of court.

We believe that this is simply a judgement that is appropriate to the degree of guilt and that the prosecution will not appeal in this weld – said Proc. Piotr Antoni Skiba at the press briefing on Friday. He pointed out that the prosecution in the indictment accused Sunday of, among another things, exceeding the authority in connection with disclosure of professional secrecy, i.e. delicate doctor's data.

Skiba pointed out that the prosecution considered that the act fulfilled 3 different offences: Article 231 paragraph 1 of the Criminal Code (excess of powers or failure to fulfil duties by a public officer), Article 107 paragraph 2 of the individual Data Protection Act (processing of individual data) and Article 266 of the Par. 2 Criminal Code (disclosure of information in connection with the performance of business activities that may harm the legitimate interest). Skiba added that the court removed from legal qualification the act from Article 231 paragraph 1 of the Criminal Code.

Doctor Piotr Pisula, whose delicate data Sunday revealed in the entry on social media told PAP that the conviction convicting the minister is satisfactory. – It has not only a individual dimension, but above all a public dimension. This is an crucial signal to politicians that they will endure the consequences of utilizing public functions against the citizen – he said.

The court, ruling on Friday on the guilt of the erstwhile Minister of Health, noted that Sunday as Minister of wellness had revealed to the unauthorised persons data on medical wellness obtained from the medical information system. The Court of First Instance noted that this was an unacceptable and incompatible measure. The Court of First Instance noted that Sunday, with information on Pisula's health, had become acquainted with the performance of his duties as Minister of Health, thereby compromising Pisula's legitimate private interest.

The territory Attorney's Office in Warsaw sent the indictment against erstwhile Minister of wellness Adam Niedzielski to court in late September.

Friday's verdict is simply a consequence of entries that Sunday as Minister of wellness posted on 4 August 2023 on Twitter (now platform X). He referred to the material aired the day before in the TVN Facts.

In a message published by the head of MZ, he later stated that the public disclosure of the prescription by a doctor employed in a city infirmary in Poznań was intended, on the 1 hand, to defend the good name of the Ministry of Health, but, above all, to defend the interests of the patient. 4 days later, on 8 August 2023, the then Prime Minister Mateusz Morawiecki reported that he accepted the resignation of Sunday as Minister of Health.
